i returned to the country for my father funeral. company has policy of person leave of absence. i passed the 30 days and got approval “by words” from my manager, who was fired from his job. Then my company told me a different story that i quit due to no-show no-contact at work. it is not a layoff according to them. so i showed up at work this week and i lost my job. can i file for unemployment or should i sue my company for this? i did not want to quit my truck driving job.

    No, if it was not in your contract or in writing then you voluntarily left.

    You can definitely file, but that doesn’t mean you will get it. You can tell the unemployment office your side of the story and show proof your father died. That would definitely help you.

    It does sound like you were fired though.

    In order to qualify for unemployment benefits you must have lost your job “through no fault of your own”.

    You were an “at will” employee. You can be fired for any reason or for no reason at all just as you are free to quit your job without an explanation.

    Can you sue? Yes. Can you win? Probably not unless you are a member of a protected group. Were you fired because of your race, ethnicity, gender, religion, creed, age (over 40), etc.? If that is the case contact the EEOC.
